Justice: new code of civil procedure to take effect on Aug. 24

Morocco’s new Code of Civil Procedure will enter into force on Aug. 24, six months after its publication in the Official Gazette, according to a directive sent by Mohamed Abdennabaoui, First President of the Court of Cassation, to courts across the Kingdom, an informed source told Le360 on Thursday.

In his directive, Abdennabaoui said the enactment of the new legislation forms part of Morocco’s broader effort to “modernize its national legal system.”

According to the directive, the new code is intended to “strengthen the efficiency of the courts, improve the quality of judicial services, facilitate access to justice, guarantee the conditions for a fair trial, enhance procedural justice and accelerate the enforcement of court rulings.

He added that “the new Code of Civil Procedure revises the general principles governing civil litigation, reorganizes jurisdictional rules and clarifies the roles of the various parties involved in civil proceedings.” The legislation also introduces digital tools into the management of judicial procedures and streamlines the enforcement process.

In the letter addressed to the presidents of the Courts of Appeal and the presidents of Courts of First Instance, Abdennabaoui also outlined the code’s main reforms, including stronger guarantees for fair trials, the digitalization of judicial procedures and measures aimed at improving judicial efficiency.

Among the new provisions is the Public Prosecutor’s authority to seek the annulment of judgments deemed contrary to public order within five years, upon written instructions from the Prosecutor General to the King at the Court of Cassation.

The directive also highlights new rules governing notifications and procedural deadlines, allowing litigants and lawyers to file applications electronically. Such submissions must now include additional information, including the litigant’s National Electronic Identity Card (CNIE) number and the lawyer’s email address.
